The Single Dwelling Covenant for the Hartlands Estate is one of the most tightly held covenants in the state of Victoria because it has been vigorously defended and duly upheld by the Supreme Court many times since the 1950s.
The most recent and successful defence of the Single Dwelling Covenant by the McCubbins Estate Committee was in 2019 when the plaintiffs withdrew their application to the Supreme Court to subdivide.
